IMPORTANT: These Terms apply to your use of the BuildHiveProject website and application.

1. Acceptance of Terms

Welcome to BuildHiveProject.

BuildHiveProject’s website, software, mobile application, trademarks, and related services (collectively, the “Platform”) are owned and operated by BuildHiveProject. (“BuildHiveProject,” “we,” “us,” or “our”).

By accessing or using the Platform, creating an account, or using any of our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. These Terms form a legally binding agreement between you and BuildHiveProject.

If you do not agree to these Terms, you must not access or use the Platform.

We may update these Terms from time to time. Any changes will be posted on our website. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

2. Who These Terms Apply To

These Terms apply to all users of the Platform, including visitors, registered users, account holders, and anyone accessing the Platform on behalf of a business or organization (“you” or “User”).

If you use BuildHiveProject on behalf of a company or organization, you confirm that you have the authority to bind that entity to these Terms.

3. Purpose of the Platform

BuildHiveProject is a project and operations management tool designed for construction and trade professionals. The Platform may include features such as project tracking, cost tracking, time tracking, client portals, reporting, and document management.

BuildHiveProject is a tool only. It does not replace professional judgment, regulatory compliance, contracts, or independent verification of costs, schedules, or work.

4. Account Registration

To use certain features of the Platform, you must create an account.

By registering, you agree to:

  • Provide accurate, current, and complete information

  • Keep your login credentials secure

  • Promptly update your account information if it changes

You must be at least 18 years old to create an account.

We may approve, reject, suspend, or terminate accounts at our sole discretion.

5. License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business or personal use, subject to these Terms and any applicable subscription plan.

You may not:

  • Copy, modify, reverse engineer, or resell the Platform

  • Use the Platform for unlawful or abusive purposes

  • Interfere with the Platform’s operation or security

  • Attempt to access systems or data not intended for you

All rights not expressly granted are reserved by BuildHiveProject.

6. User Responsibilities

You are responsible for:

  • How you use the Platform and its outputs

  • All data, inputs, and decisions made using the Platform

  • Ensuring compliance with applicable laws, contracts, and regulations

You agree not to misuse the Platform or use it in a way that could harm BuildHiveProject or other users.

7. Accuracy and No Professional Advice

While we aim to provide reliable tools and functionality, BuildHiveProject does not guarantee that:

  • Data, calculations, reports, or outputs are accurate or complete

  • The Platform will meet your specific requirements

  • Results are suitable for decision-making without independent review

You must independently verify all project data, costs, schedules, and outputs before relying on them.

8. Third-Party Services

The Platform may include links to or integrations with third-party websites or services.

BuildHiveProject is not responsible for third-party content, services, availability, or practices. Use of third-party services is at your own risk and subject to their terms.

9. Intellectual Property

All software, designs, trademarks, logos, content, and technology used in the Platform are the exclusive property of BuildHiveProject or its licensors.

You do not acquire any ownership rights in the Platform by using it or maintaining a paid account.

10. Your Content

You retain ownership of content you upload or create using the Platform, such as project data or documents.

By using the Platform, you grant BuildHiveProject a limited right to store, process, and display your content solely for the purpose of providing the services.

You are responsible for your content and how it is used.

11. Marketing and Communications

By creating an account, you consent to receive service-related communications. You may also receive marketing communications, which you can opt out of at any time in accordance with applicable law.

12. Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect personal information in accordance with Canadian privacy laws.

13. No Warranties

The Platform is provided “as is” and “as available.”

BuildHiveProject disclaims all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability, and non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law:

  • BuildHiveProject is not liable for any indirect, incidental, consequential, or economic damages

  • We are not liable for loss of profits, business interruption, data loss, or decisions made using the Platform

If liability cannot be excluded, our total liability is limited to the lesser of:

  • Re-performing the service, or

  • One month of subscription fees paid by you

15. Indemnification

You agree to indemnify and hold harmless BuildHiveProject, its directors, officers, employees, and contractors from any claims, losses, or expenses arising from:

  • Your use of the Platform

  • Your content

  • Your violation of these Terms

16. Suspension and Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms or misuse the Platform.

You may stop using the Platform at any time.

17. Availability and Changes

We do not guarantee uninterrupted availability. Maintenance, updates, or technical issues may result in downtime.

We may modify or discontinue parts of the Platform at any time.

18. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

Any disputes will be resolved exclusively in the courts of Ontario.
